GUILTY: S. Whitley man admits sexual misconduct

May 16, 2013

COLUMBIA CITY — Less than a week short of a jury trial, a South Whitley man admitted his guilt in a sex case with a minor.

Timothy J. Swihart, 19, pled guilty to sexual misconduct with a minor, a Class C felony, last week.

As part of a plea arrangement, Swihart will receive a six-year sentence with a cap on time served being four years.

A second part of the agreement is to have two counts of perjury against Swihart dismissed.

Swihart was arrested in January. The victim in the case, a 14-year-old girl, had visited a school counselor, fearing being pregnant.
