IN COURT: Smith pleads guilty to burglary charge

COLUMBIA CITY — A Pierceton man pleaded guilty to a burglary charge in Whitley County Circuit Court Monday.

Jeremiah Smith, 26, pleaded guilty to burglary, a Class C felony. With his criminal history, he also was charged with being a habitual felony offender as part of a plea arrangement.

A charge of theft, a Class D felony, was dismissed as part of the agreement.

Smith admitted to breaking into the Larwill Deli, located at U.S. 30 and Ind. 5. He was accused of stealing $1,252.76 of merchandise — 12 cartons of cigarettes.

The back door, door locks and hinges were also broken during the crime, which was estimated to be $650 in damages.

This incident occurred Sept. 9, 2012. Smith was arrested Oct. 9, 2012.

Law enforcement began to suspect him when a tip came in that Smith’s girlfriend was trying to sell cigarettes online.

When investigators arrived at the house, they photographed shoes belonging to Smith, and the shoes resembled those of the person seen on surveillance who broke into the store.
