WARSAW â€” Whitley County Circuit Court Judge James Heuer is taking on a Kosciusko County case after the Indiana Court of Appeals ruled that the case was mishandled.
Heuer will determine whether 15-year-old Paul Gingerich should be charged as an adult after allegedly helping kill his friendâ€™s stepfather in 2010 â€” when he was 12 years old.
The change of venue occurred after a dispute on whether he should be tried as an adult or a juvenile.
In December, the Indiana Court of Appeals threw out his original plea deal, saying the Kosciusko County judge who handled the case moved it to adult court unfairly.
Judge Duane Huffer, a juvenile court judge in Kosciusko County, ruled in 2010 that the case be moved to circuit court for the boy to be tried as an adult.
Gingerich pleaded guilty to a conspiracy to commit murder charge after the death of Phillip Danner three years ago.
